States' Rights

So.. I am reading about European Internal Market Law for my course... and the issue of State's rights keeps popping up in my head. From my television biased childhood, relying on the media and outdated text books for information all I can remember gleaning about states' rights was that it was always a devisive phrase used by typically southern conservatives barking about some federal mandate imposing some sort of legal standard (usually about black people) and that is about all I remember.

But now, I am starting to consider things differently. Get to the source. Actually what does the term mean. So, started with wikapedia.
Searched on : States' rights
"From Wikipedia, the free encyclopedia
(Redirected from States rights)
States' rights refers to the idea that U.S. states possess certain rights and political powers in the politics of the United States and constitutional law. These rights are guaranteed by the Tenth Amendment to the United States Constitution, under the United States Bill of Rights. The states' rights concept is usually used to defend a state law that the federal government of the United States seeks to override, or a perceived violation of the bounds of federal authority.
The principle of federal powers over those powers held by the states was laid out by John Marshall, the third Chief Justice of the Supreme Court of the United States. In the seminal case of McCulloch v. Maryland, Marshall asserted, based on the supremacy clause of the United States Constitution, that the laws of the federal government were generally paramount over the laws of the separate state governments. The debate surrounds the issue of what powers Congress possesses and can grant to the federal government, and whether the States nonetheless possess those powers to the exclusion of the federal government even if the Constitution does not explicitly grant them to the States." (above quote taken from wikapedia web page sourced)
Living in Ohio you see the problem of the US completely. If you don't have the funds, you got nothing! You are down hard! I currently live in a region that is loosing population and has been for awhile. Maybe we should turn the state back into farm land, forget our brief (~100 year) industrial history. If we as a State can't "compete" on a national scale then throw in the towel. But... "it", states' rights is in the constitution, be it an amendment, but it remains to keep these, rights of the people of a particular state in place, the rights of the state to legislate it's own matters within the envelope of the federal level.

In my studies, the European Union internal market, this is the balancing act that is being attempted. So I ask, what the heck happened in the US? It started off pretty sweet, and got all jacked up in the process.... Sure, it might be good in Oregon or Texas, but I don't live in Oregon or Texas now, should a "Federal" policy then be created, to eliminate economically "lagging" states and just return the land to nature? Where is the market's "invisible hand" to get this state out of it's financial dispair........oh yeah, that "hand" will be pulling the lever on some new slot machines.

tesla 2

http://en.wikipedia.org/wiki/Nikola_Tesla

2006 is the 150th birthday of Tesla, a Serbia (an orthodox) inventor who produced one of many theories in Electromagnetics but one that I am particulary found of is the theory for "free energy".

The man was brilliant! Currently the work I do... revolves around everything this guy put to practice 100 years ago....

.....

oh and by the way... i got a flat tonight.... in the rain... i rode downtown...met a colleague from Best, NL for dinner and drinks...then on my ride home... which is only 30 minutes by bike with a functional bike by the way... i notice my front tired sagging a bit...
By the time I crossed 490.. I knew it was flat, shit..... so i walked it for a bit , then I rode and did mini-wheelies over the cracks in the sidewalk so I wouldn't kink my rim... oh well... either I hit some glass on all the shitty sidewalks on the way down, or someone sabotaged me.????

Either way the irony is that by the time I reached my house, it stopped raining....

last night...

I had a bike experience to no other. It was grand! I spent the entire day touring Cleveland. First rode to Tremount from the village...had to make a secret detour at the "steel yard commons" fancy construction site. Stopped at Lucky's for a sandwhich... then on to downtown for the tail end of tailgating with my friend SJ. On the route I got to see the entire spectrum of the society, from the Puerto Rican neighborhood around Scranton and Denison to the Artist and Bohemian's at Lucky's then to the sports fans and the mainstream at the Muni-Lot. And all along the way by the bike... rode home from the pub around 2130 and put the bike, my friend let me borrow his bike with gears, ( i kind of like gears, I see why people have them) into the "big" ring and rode hard. I was going fast up broadway... and got home around 2200.

a book i read...

Found this book in a small book store, Behemot Bookshop, in Ljubliana, Slovenia. www.behemot.si
http://www.powells.com/cgi-bin/biblio?show=trade%20paper:new:0971394253:12.95

I thought it was a good read. Not just complaining without solutions or even just surface level complaining at obvious stuff. Actually diving into the "root" cause. Of course if you see nothing wrong in the society this book makes no sense at all, why would it even be written? some might say. I disagree with that point of view, so nevertheless, it examines the larger context of issues that always seemed to "bug" me as an adolescent and young adult. The interesting thing I consider is that I think in the end most people of western culture want the same thing it is just a matter of negotiations on how to get what we want and what will the "cost" include.

energy!

download some podcasts and check it out.

Oh, I folded this week and drove my car, but the irony is I started my car today and it was making some funny noises... the car sounded tired. I think it is.

But the bike is well... I rode to my friend Tina's store today for groceries. Tina's store is called Seven Roses. It is on Fleet in Slavic Village in Cleveland. Fresh food and I can practice my Polish.
